TERMS & CONDITIONS

Thank you for considering AMERIASA TOURS & TRAVEL SDN BHD (“Ameriasa”) for your travel needs. We are committed to providing you with the best possible service and ensuring that you have an enjoyable and hassle-free experience. By booking with Ameriasa, you agree to the general/cancellation terms and conditions contained herein, where you are deemed to have read, understood and accepted. Any payment constitutes a further acceptance of the terms herein. All policies, procedures and terms contained herein are subject to change at any time without notice at Ameriasa’s sole discretion. Contracted corporate tours may have special terms and conditions, please refer to your corporate travel contract (if any).

Booking and Payment:

• All bookings are subject to flight and/or tour availability.
• A booking fees or full payment may be required at the time of booking, depending on the package and travel dates.
• A reservation will be affected upon receipt of your booking fees. The booking fees form part of your final payment.
• Balance or full payment must be made to Ameriasa 30 days prior to scheduled departure, failing which may result in a cancellation of your booking and forfeiture of your booking fees.
• All payment must be made payable to AMERIASA TOURS & TRAVEL SDN BHD, via Cash / Online telegraphic transfer/ E-wallet / credit card (subject to 2% administration fees).
• All bookings and purchases shall be made in Malaysian Ringgit (MYR) based on the exchange rate on date of payment and foreign currency booking or purchase shall be converted to MYR on the date of the said payment.
• Service Charges may apply and charged for each booking made. Service Charges shall be reflected in your invoice.
• Bookings and/or reservations must be made in your name as displayed on your NRIC / passport. National and/or international regulations may require you to provide your full name as it appears on your travel documents, date of birth, and gender at the time of booking for the purpose of watch-list screening. Failure to provide accurate information upon booking and/or immigration screenings will result in you not being allowed to travel. Name changes are generally not allowed, and you will be required to make new booking and/or reservation.
• If you provide any information that is untrue, inaccurate, not current or incomplete, Ameriasa has the right to cancel your booking which may result in forfeiture of your booking fees.
• Confirmation of a booking includes the essential elements including the description of the travel / tour service booked and the price, which will be sent to you via email or any electronic means, including but not limited to messaging platforms including Whatsapp. If you do not receive a written confirmation after 24 hours of placing the booking, you should immediately contact Ameriasa.
• It is expressly agreed that information and/or data stored by Ameriasa and/or its suppliers shall constitute valid proof in relation to the booking(s) made by you. Information and/or data stored in computers or electronic media are deemed valid proof, and shall therefore be acceptable under the same conditions and with the same evidential value as a physical written document.

Changes and Cancellations:

• Cancellation and/or changes to your booking must be made directly with Ameriasa.
• A change to the entire booking shall be considered as a cancellation and may subject to cancellation charges.
• You may cancel your booking at any time. Cancellations of booking must be made in writing to avoid any undisputed and/or misunderstanding.
• Ameriasa reserves the right to cancel your booking in the event of unforeseen circumstances and/or Force Majeure events, including but not limited to natural disasters, political unrest, acts of God, war, transportation or other forms of strike, civil strike, pandemic, endemic and order from the Government of Malaysia and/or other countries.
• Please refer to our cancellation policy, which is also outlined in your booking confirmation.
• Ameriasa reserves the right to cancel or withdraw any bookings or itinerary or decline to accept or retain any person as member of a tour or booking, if any such person may appear likely to endanger and/or cause to endanger and/or pose a threat to the health, safety, comfort and/or enjoyment of the others on the tour. Ameriasa further reserves the right to cancel the tour altogether if the circumstances dictate so.
• If for any reason, any carrier, hotel or other service providers refuse to allow you to participate in the tours, Ameriasa’s sole liability shall be limited to refunding to you any monies paid less any amounts for the services already utilised, administration, cancellations fees and other deductions in compliance to the service provider’s terms and conditions and/or policy on refund.

Travel Document:

• It is your responsibility to ensure that you have all necessary travel documents, such as a valid passport and visa to be in order.
• Ameriasa shall advise you on the documentation and/or travel documents required prior to departure.
• As a guide, you must have an international Passport or other recognised travel documents which should be valid for at least six (6) months from the date of the departure from the last destination of your itinerary.
• You must have the necessary visas, vaccinations and health certificates as may be required by the Government authorities of the countries you are visiting.
• It can often take some time to obtain a visa, so you are advised to apply in advance. Requirements may change and you should check for up-to-date information before booking and departure.
• Ameriasa shall whenever possible assist you to obtain the necessary visas, where all service charges and visa fees levied for visa application purposes shall be borne by you. Approval of the visa application shall be at the sole discretion of the respective country’s Immigration Department / relevant authorities.
• Ameriasa shall not in any event be held responsible or liable for any costs, expenses, reimbursements and/or refund of the tour prices should you are refused entry by any country on the tour for whatsoever reasons, including incorrect or incomplete travel documents. This includes all stops made by the aircraft, even if you do not leave the aircraft or airport.

Travel Insurance:

• Ameriasa strongly advise and recommend that you take out insurance with reputable insurance companies and/or providers that covers the consequences of certain cases of cancellation and that also provides cover for certain special risks such as the cost of repatriation in the event of an accident or illness and to protect yourself against any unforeseen circumstances that may arise before or during your trip.
• It remains your responsibility to ensure any insurance policy taken out is adequate to cover your requirements.
• Although most travel, including travel to international destinations, is completed without incident, travelling to certain destinations may involve greater risk than others. Ameriasa urges you to review any travel prohibitions, warnings, announcements and advisories issued by Wisma Putra prior to booking travel to international destinations.
• Recommended inoculations for travel may change and you should consult your doctor for latest recommendations before you depart. It is your sole responsibility to ensure that you meet all health entry requirements, obtain the recommended inoculations, take all recommended medication, and follow all medical advice in relation to your trip. For medical advice regarding your journey, please consult your doctor.

Restricted Fares:

• Unless otherwise requested by you, it is assumed that you opt for the least expensive services. Such services may be provided without any possibility of modification or cancellation. In such cases, the services cannot be provided in a different manner or at a different time or place to those contracted.

Special Requests:

• If you request special arrangements such as adjoining rooms/room locations, bedding requests, specific assistance or special meals, we will pass on your request to the service provider on your behalf. However, since these requests lie outside our contracts and/or arrangement with our suppliers, we cannot guarantee your special requests will be met unless otherwise stated.

Air Transport Terms & Conditions:

• You are solely responsible for complying with the rules and instructions of the airline and/or tour operator, in particular with respect to flight check-in and boarding times. In particular, you acknowledge and agree that:-
– Airlines reserve the right to cancel or modify flight schedules without notice. Schedules provided by Ameriasa to you are based on the expected flying times as indicated by the airlines. Due to the fact that weather and other factors may affect operating conditions, timely departures and arrivals cannot be guaranteed, to which you acknowledge and agree shall never be the responsibility of Ameriasa.
– Ameriasa has no control over the allocation of seats on any air transport, even if the seats are pre-booked with the airline, and does not guarantee that specific seats will be available on departure.
– Ameriasa has no control over any indications of the time spent flying which are provided by the airlines and are given only for guidance and are subject to alteration.
– Whilst Ameriasa will endeavour to advise you on the same, it is ultimately your responsibility to confirm your return flight in accordance with the requirements of the airlines.
– If a return flight was booked but you do not / did not use the outward flight, the airlines may cancel the return flight without refund. This also applies if the return flight is not taken and insofar as the travel is not taken at all.
– In the case of special or chartered flights, the name of the airline, the flight schedule, the aircraft type, the itinerary and possible intermediate stops are only given as an indication of the outward and return flights on the trip. Subject always to the airlines’ rules and restrictions, these flights, aircraft types and flight numbers may subject to change, even after confirmation.
– Additional charges may be imposed by airlines for meals, luggage, seat selection and/or other services. Ameriasa is not responsible for such charges and may be amended by airlines at any time.
– If you or your family member on your booking is pregnant, it is your responsibilities to comply with all airlines’ rules and restrictions in the case of carriage of pregnant women.
– You must comply with the airlines’ rules and restrictions on the carriage of children and in particular that children not older than two (2) years must have a return ticket for both the outbound and inbound flights. In the event of non-compliance, you will not be eligible for a refund of any seat charges incurred during travel. Children under two (2) years will not be allocated their own seat in the aircraft, unless a child flight ticket / fare has been booked for them. Unaccompanied children under fourteen (14) years will only be carried in accordance with the airlines’ rules and restrictions.
– The flight routes offered may include special fares which offer the best price, but do not necessarily take the most direct route. Some itineraries require a change of aircraft en route. A flight that is described as direct is one where there is no need to change aircraft during the journey, should no special circumstances occur.

Tour Information & Prices:

• Prices shown or quoted are correct at the time of publication information and the price list forms part of the brochure and webpage. The prices are subject to change due to increase in airfares, exchange rates, other transport costs, hotel rates, government tax, etc, and therefore Ameriasa reserves the right to increase prices accordingly without due notice to you.

Responsibility:

• The information, software, products and services provided by Ameriasa may include typographical errors. Wholesalers, airlines, hotels, service providers and other suppliers providing travel or other services (collectively the “Suppliers”) for Ameriasa are deemed independent contractors and not agents or employees of Ameriasa. As such, Ameriasa shall not be liable nor shall Ameriasa be held responsible for acts, errors, omissions, representations, warranties, breaches or negligence of any such Suppliers or for any personal injuries, death, property damage or other damages or expenses resulting from acts or omissions occasioned by the Suppliers.
• Ameriasa shall make no refund or compensation in the event of any delay, cancellation, overbooking, strike, force majeure, pandemic, endemic or other causes beyond the direct control of Ameriasa and shall have no responsibility for any additional expense, omissions, delays, re-routing or acts of any Government or relevant authority.
• All claims against Ameriasa must be made in writing within thirty (30) days after the completion of the tour.
• If you have a complaint, you must provide Ameriasa with a reasonable opportunity to rectify the issue during your vacation by promptly notifying our representative who will make every effort to assist. If the matter cannot be settled on the spot, you must write to us within thirty (30) days of the completion of your vacation. Please understand that Ameriasa cannot consider post-vacation complaints if you did not provide Ameriasa with a reasonable opportunity to assist you during your trip. We reserve the right to give any compensation due in the form of future Travel Credits.
• By booking with Ameriasa, you agree to defend and indemnify Ameriasa and any officers, directors, employees and agents of Ameriasa from and against any claims, causes of action, demands, recoveries, losses, damages, fines, penalties or other costs or expenses of any kind or nature including but not limited to reasonable legal fees, brought by third parties as a result of your wrongful conduct during the tour, breach of these Terms and Conditions or the documents referenced herein, your violation of any law or rights of a third party, or your use of Ameriasa’s website and/or any travel documents.

Exclusion of Liability:

• Ameriasa and its associated agents act only as agents for you and the transportation companies such as airliners, car rental companies, coach companies, excursion companies, accommodation companies’, entertainment and meal suppliers and other principals involved in the tour and/or services you have booked. All tickets, voucher and documents under which such transportation and other services are provided by the abovesaid companies and/or principals, unless otherwise specified by Ameriasa.
• Ameriasa and its associated agents and representatives are not responsible and expressly exclude liability for any injury, illness, damage, loss, delay, accident or irregularities that maybe caused to you or a person or property and all bookings are subject to the usual terms and conditions and contract of the Suppliers involved. In no event shall Ameriasa be liable for any direct, indirect, punitive, incidental, special or consequential damages arising out of contract or in tort for any injury, damage, loss, delay, additional expenses or inconvenience caused directly or indirectly by events which are self-inflicted or due to your own negligence or are not due to Ameriasa’s negligence or are beyond Ameriasa’s control or which are not preventable by reasonable diligence on its part including but not limited to war, civil disturbances, fire, floods, unusually severe weather, acts of god, act of government or of any authorities, accidents to or failure of machinery or equipment or industrial action.
• Ameriasa makes arrangements with third party Suppliers as independent contractors for the various components that comprise your tour and/or vacation package. We have taken all reasonable steps to ensure that proper arrangements have been made for your vacation. However, Ameriasa is not an agent of these independent service providers and Ameriasa expressly disclaim any liability for their actions or omissions. Service providers reserve the right to refuse service to you at their sole discretion. Ameriasa assumes no liability for the acts of the service provider in refusing service. Ameriasa is not responsible for schedule changes issued by the airline and does not offer compensation for those changes. Ameriasa will not pay an increase in fare for an alternative airline.
• Ameriasa is not responsible under any circumstances for any injury or damages you may suffer, in connection with air or ground transportation, hotel accommodations, or other travel or excursion services arranged by Ameriasa. Furthermore, Ameriasa and its third-party Suppliers do not control and cannot be responsible for bodily injury, property damage or other loss or damage caused by factors beyond their control, including but not limited to: air turbulence, flight delays, extreme weather, government restrictions or regulations, strikes, war, acts of terrorism, mechanical breakdown, sickness or disease, epidemics or pandemics, quarantine, your physical, medical or mental disabilities, your failure to obtain valid travel documents or to follow travel instructions resulting in denied entry at destination or re-entry into Malaysia and failure related to the public internet, telephone or other communication lines.
